In the
judgment that may cause ripples in the cosmetic industry, a consumer court has imposed a penalty of
RS.15 lakh on EMAMI LIMITED for “misrepresenting”
EMAMI had adopted unfair trade practices
by claiming through its advertisement that its product fair and handsome cream would given men
fairer skin in three weeks.
MR. Nikhil jain
had filed an unfair trade practices suit against EMAMI in the consumer court
after, contrary to its advertisement. Mr. jain had purchased the cream on October
8,2012 “ after using the cream for three
weeks , I did not see any difference on my face,” he said in his complaint.
The consumer
forum bench stated that emami’s advertisement amounted to misrepresentation to
the public at large about the product’s effectiveness.
“NO attempt has
been made….. to justify the advertisement which hold out a promise of the skin
getting fairer by use of the product”
said the forum.
DECISION : The bench directed EMAMI LIMITED to pay Rs.10000
as compensation to Mr.jain and deposit
Rs.15 lakh as punitive damages with the consumer welfare fund maintained in the
delhi state consumer disputes redressal commission.
The forum
has now directed to EMAMI to withdraw the advertisemens.
